Terms of Service

These Terms of Service ("Terms") govern your use of the Baavana mobile and web application ("Baavana", the "app"). Please read them carefully. By creating an account or using the app, you agree to these Terms.

Baavana is a small, invite-only app for a homebrew festival. It is operated by an individual, not a large company. We have done our best to make it work well and to keep your information safe, but it is provided as-is on a best-effort basis.

1. Who we are

Baavana is operated by Nic Gibbens, sole trader trading as MakeYourOwnSpace, based in Wellington, New Zealand. References to "we", "us", and "our" in these Terms mean MakeYourOwnSpace.

You can contact us about anything in these Terms at support@baavana.app.

2. Who can use Baavana

You may use Baavana only if all of the following are true:

You are at least 17 years old.
You have been invited by a festival organiser and have a valid registration code.
You agree to comply with these Terms and our Privacy Policy.

The app is unlisted on the App Store and intended for a small, known group of festival attendees. It is not a public social network.

3. Your account

You are responsible for keeping your account secure. Don't share your sign-in credentials. If you suspect unauthorised access, contact us at support@baavana.app as soon as practicable.

You must provide accurate information when registering. We may suspend or remove accounts that violate these Terms.

4. User-generated content

Baavana lets you post ratings, comments, photos, and captions ("Your Content"). You retain ownership of Your Content, but by posting it you grant us a worldwide, non-exclusive, royalty-free licence to host, display, and distribute it within Baavana for the purpose of operating the app.

What you may not post

You agree not to post Your Content that:

Contains hate speech, slurs, or discrimination against any person or group.
Harasses, threatens, or intimidates another person.
Sexually exploits or endangers minors in any way.
Infringes someone else's intellectual property, privacy, or personality rights.
Contains malware, spam, or unsolicited advertising.
Violates New Zealand law or the law of any place where the content is accessed.

Reporting and moderation

If you encounter content that violates these Terms, use the in-app Report action on the offending content. You can also block another user from your view of the app using the in-app Block action — once blocked, their photos and comments will not appear in your feed.

We act on confirmed violations promptly, typically within a few days. We aim to address reports as soon as practicable, taking into account that this is a small-team-operated festival app and we may not have weekend coverage during the festival itself.

Action on a confirmed violation may include removing the content, removing the account, or both. We may also remove content for any other reason at our discretion (for example, content that conflicts with the festival organiser's guidelines).

5. Account deletion and data retention

You can delete your account at any time from Settings → Delete account inside the app. When you delete your account:

Your authentication record is removed.
Your push notification tokens, your block list, and your festival attendance records are removed.
Your ratings, photos, and comments are anonymised — they remain visible in the leaderboard and photo feed but are attributed to "Deleted user" rather than your name.
The photo image files themselves remain in storage.

We retain anonymised content because removing it would create gaps in the festival's leaderboard scoring and photographic record. If you require full removal of a specific image (for example, a photo that contains personal information you no longer wish to be hosted), contact us at support@baavana.app and we will remove it within a reasonable time.

6. Intellectual property

The Baavana app, its visual design, brand, and the curated festival content (event names, beer catalog) are the property of MakeYourOwnSpace or licensed to us. You may not copy, modify, or redistribute the app or its assets without our prior written permission.

7. Disclaimers

The app is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or secure.

Beer ratings, comments, and photos are user-generated. We do not endorse or verify any user's content. Drink responsibly.

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993 if it applies, or any equivalent consumer-protection law in your jurisdiction.

8. Limitation of liability

To the maximum extent permitted by law, in no event will MakeYourOwnSpace be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of Baavana, including loss of data, loss of profits, or loss of goodwill.

Our total aggregate liability arising out of or in connection with these Terms or the app is limited to NZ$50.

9. Termination

You can stop using the app at any time by deleting your account. We can suspend or terminate your access to Baavana at any time without notice if you violate these Terms or if we cease operating the app (for example, after the festival ends).

10. Governing law

These Terms are governed by the laws of New Zealand. Any dispute arising out of or in connection with these Terms is subject to the exclusive jurisdiction of the courts of New Zealand.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent change. Material changes will be communicated in the app before they take effect. Continued use of the app after changes take effect means you accept the updated Terms.
